1. Overview

This Privacy Policy describes how Market Rush and its affiliates (collectively, “we”, “our”, “us”) collect, use, share, protect, or otherwise process your information or personal data through our website https://marketrush.in and related Platform (hereinafter the “Platform”).

Please note that you may be able to browse certain sections of the Platform without registering with us. We do not offer any product or service under this Platform outside India and your personal data will primarily be stored and processed in India.

By visiting this Platform, providing your information, or availing any product or service offered on the Platform, you expressly agree to be bound by the terms and conditions of this Privacy Policy, the Terms of Use, and the applicable service or product terms and conditions, and agree to be governed by the laws of India, including but not limited to laws applicable to data protection and privacy. If you do not agree, please do not use or access our Platform.

1.2 Scope

This Policy applies to visitors, registered users, evaluation participants, and other individuals who interact with our Platform, Services, or related programs. Information collected through third-party business partner platforms may be governed by their own privacy policies, and we are not responsible for those practices.

2. Information We Collect

2.1 Account & Contact Data

Name, email address, phone number, login credentials (hashed), communication history with support, and other details you provide when creating an account or contacting us.

2.2 Identity Verification (KYC) Data

Where required for access to certain program features (e.g., Rewards eligibility), we may collect identity verification information such as PAN, government-issued ID (Aadhaar/Passport/Driving License), address proof, and bank account ownership proof. In some cases, we may request selfie/liveness checks or additional documentation through verification partners.

2.3 Payment & Transaction Data

Evaluation fee payment confirmations and limited transaction metadata provided by payment gateways (e.g., payment status, reference IDs). We do not store complete card details. UPI identifiers or masked metadata may be retained where provided by payment processors for reconciliation, refunds, dispute handling, and compliance.

2.4 Program & Performance Data

Simulated orders, fills, P&L, rule events (e.g., loss limits), square-off events, and related analytics generated during program participation. This information is used to display your performance and enforce program rules.

2.5 Device, Usage, Security Logs & Cookies

We may collect technical and usage information such as IP address, browser type, device identifiers, operating system, timestamps, pages/screens viewed, referral URLs, session activity, error logs, and cookie identifiers. We may also use device fingerprinting and similar signals to detect fraud, prevent abuse, and secure accounts. See Section 10 (Cookies).

2.6 Communications

If you contact us, we may store your messages, call recordings (where permitted), chat logs, WhatsApp/SMS/email communications, and related metadata for support, quality, and compliance.

3. How We Use Information

3.1 Provide & Operate the Services

Create and manage accounts, deliver the evaluation environment, display program dashboards, enforce rules (including intraday square-off timing), administer evaluations, and provide platform features.

3.2 Payments, Invoicing & Refunds

Process evaluation fees, generate invoices/receipts, reconcile payments, handle refunds in accordance with our Cancellation & Refund Policy, and resolve billing issues.

3.3 Verification, Eligibility & Compliance

Verify identity (KYC where required), prevent misuse, comply with legal obligations, respond to lawful requests, manage disputes, and support program integrity checks.

3.4 Security & Fraud Prevention

Detect, investigate, and prevent fraud or abuse (including platform manipulation, suspicious login activity, automation/bots, exploitation of latency/glitches, and account sharing). We may use device fingerprinting, IP analysis, and behavioral signals to secure accounts and systems.

3.5 Communications & Support

Send essential service notices, verification requests, security alerts, program updates, and respond to support inquiries. We may also send optional marketing communications where permitted, and you may opt out of marketing communications at any time.

3.6 Analytics & Improvement

Analyze usage trends to improve performance, reliability, user experience, security controls, and the fairness and robustness of evaluation execution.

4. Lawful Purposes & Consent

We process personal information in accordance with applicable law, including India’s Digital Personal Data Protection framework. We use personal information only for lawful purposes such as providing the Services, fulfilling contracts, complying with legal obligations, protecting users and systems, and pursuing legitimate business interests such as platform security and improvement. Where required, we obtain your consent and you may withdraw consent as described in Section 9.

5. Sharing & Disclosure

5.1 Service Providers

We may share personal information with trusted vendors who provide services on our behalf, including hosting/cloud infrastructure, reference data providers, payment processors, email/SMS/WhatsApp providers, analytics providers, customer support tools, and KYC/verification partners. These vendors are required to implement reasonable safeguards and process data only for authorized purposes.

5.2 Legal & Compliance

We may disclose information if required by law, regulation, legal process, or lawful government request, or where necessary to protect the rights, safety, and security of Market Rush, our users, or the public.

5.3 Business Transfers

In a merger, acquisition, restructuring, financing, or sale of assets, personal information may be transferred as part of the transaction, subject to appropriate protections and this Policy.

5.4 No Sale of Personal Data

We do not sell personal information to third parties for their independent marketing.

We may also collect or receive information related to your transactions on the Platform and on third-party business partner platforms. When a third-party business partner collects personal data directly from you, you will be governed by their privacy policy. We are not responsible for the privacy practices or content of these third-party policies, and you should review them before sharing information.

If you receive an email, call, or message from anyone claiming to be Market Rush seeking personal data such as debit/credit card PIN, net banking password, or mobile banking password, do not provide such information. If you have already shared it, report the incident immediately to an appropriate law enforcement agency.

6. International Transfers

Our infrastructure and service providers may process information in India or other countries. Where cross-border transfers occur, we implement reasonable safeguards consistent with applicable law and contractual requirements. By using the Services, you acknowledge that your information may be processed outside your jurisdiction.

7. Data Retention

We retain personal information for no longer than is required for the purpose for which it was collected, or as required under applicable law. In some cases, we may retain limited information for longer periods where necessary to prevent fraud or future abuse, to defend legal claims, or for other legitimate purposes.

We may also retain aggregated or anonymized data for analytical and research purposes provided that such data cannot reasonably be used to identify you.

Retention periods vary by category and may include:

  • Payment and invoicing records
  • KYC/verification records (where applicable)

8. Security

We use reasonable technical and organisational measures to protect personal information, such as encryption in transit, access controls, logging, and least-privilege practices. However, no method of transmission or storage is 100% secure. You are responsible for maintaining the confidentiality of your credentials and restricting access to your devices.

9. Your Choices & Rights

9.1 Access, Correction, Deletion

You may request access to, correction of, or deletion of your personal information, subject to legal exceptions and verification. Some data may be retained where required for compliance, security, dispute resolution, or fraud prevention.

9.2 Withdraw Consent / Marketing Preferences

Where processing is based on consent, you may withdraw consent at any time. Withdrawal does not affect processing already completed. You may opt out of marketing communications via the unsubscribe link or by contacting support.

You may withdraw consent by writing to the Grievance Officer at the contact information provided in Section 13. Please mention “Withdrawal of consent for processing personal data” in the subject line. We may verify such requests before acting on them. Withdrawal will not be retrospective and will be managed in accordance with this Privacy Policy, our Terms of Use, and applicable laws.

If you withdraw consent for processing personal data that is necessary for providing our Services, we may restrict or deny access to those Services.

10. Cookies & Similar Technologies

We use cookies and similar technologies for essential functionality (authentication, security, session management) and to understand usage patterns (analytics). You can control cookies through your browser settings. Disabling cookies may impact certain features of the Services.

11. Children

Our Services are intended for adults. You must be at least 18 years old to register. If we learn we have collected personal information from someone under 18, we will take reasonable steps to delete it, except where retention is required for legal compliance or to protect our systems.

12. Changes to this Policy

We may update this Policy from time to time. Material changes will be notified via email or your user area. Your continued use of the Services after notice constitutes acceptance.

Market Rush operates an evaluation platform and is not a SEBI-registered intermediary. Rewards eligibility, verification requirements, and any rewards-related processing (if applicable) may be governed by additional agreements and program rules presented to you at the relevant time. This Policy forms part of our Terms & Conditions.
